Court restrain SSS, Bauchi Government over alleged land encroachment in Firo
From Ahmad saka,BauchiBauchi State High Court Presided over by Justice Aliyu bin Idris has restrained the State Security Service SSS, Bauchi State Government from further entering vast land situated at Firo in Ganjuwa Local Government Area of the State.
Justice Aliyu have the ordered today after he listened to motion experte filed by Barrister Abdullatif Gwani Isa in a suit number BA/251/2026 on behalf of the owners of the vast land plot in Fito, Hajiya Fatima Abdullahi, Ishaq Mohammed Kobi , and Murtala Isma’il.
The plaintiffs filed the suit against the Ministry of Land and Survey Bauchi State , Attorney general Bauchi State and State Security Service, Bauchi Command Headquarters.
Barrister Isa told the court that the Plaintiffs are the lawful owners of the vast land at Firo which they acquired the land titles through lawful purchase and grants allocation from Ganjuwa Local Government Authority,.
He said Since acquisition the claimant’s have exercised undisturbed act of ownership and possession including farming and demarcation into smaller plot for the purpose of selling same, without any adverse interference until the events that led to this suit.
Barrister Isa told the court that in 2020 the Ministry of lands acquired portion of lands from various individuals including Hajiya Fatima Abdullahi first claimant to enable the SSS the establish a training School, the previous purchased was specific to that defined area did not extend to the vast land now in dispute.
He explained that in 2024 the SSS expressed interest in purchasing additional 208 plots from Hajiya Fatima Abdullahi first claimant, after the first claimant submitted a letter of intent to sell ,the SSS failed to respond,prompting Hajiya Fatima to continue marketing her plot to the public,
Barrister Isa said the SSS acting in concert with the Ministry of Land and Survey entered the claimant’s land without any legal authorisation, no notice of acquisition or payment of compensation.
He said the SSS have commenced mounting beacons and demarcation of the land effectively attempting to annexe the land illegally.Barrister Isa alleged that agents of SSS have issued death threats to the claimant’s stating that they will shoot at anybody who dare to enter or work on the land thereby depriving the claimant’s of their possessory and ownership rights.
He said the claimant’s land has never been lawfully acquired for the public purpose under the land use act, unless the defendants are restrain by the court the defendants will continue of their act of tress pass and may permanently alienate the claimant’s from their ancestral acquired property.
After listening the plaintiffs lawyers submission the presiding Judge Justice Aliyu bin Idris ordered the defendants to stop further entering mounting beacons demarcating or in any other manner interfere with applicants possessory rights over the vast land in Firo along Gubi Dam in Bauchi State pending the hearing and determination of the Motion on Notice and adjourned the suit to 18th June 2026.
